New Motor Vehicles Penalty Charges

Below are the New Proposed Provision / Minimum Penalties with section and descriptions.

1. General – Section: 177 – Old Penalty: Rs 100 – New Penalty: Rs 500

2. Speeding / Racing – Section: 189 – Old Penalty: Rs 500 – New Penalty: Rs 5,000

3. Without Helmet – Section: 194 D – Old Penalty: Rs 100 – New Penalty: Rs 1000 Disqualification for 3 months for licence.

4. Without Seat belt – Section: 194 B – Old Penalty: Rs 100 – New Penalty: Rs 1000

5. Over speeding – Section: 183 – Old Penalty: Rs 400 – New Penalty: Rs 1000 for LMV Rs 2000 for Medium passenger vehicle

6. Drunken driving – Section: 185 – Old Penalty: Rs 2000 – New Penalty: Rs 10,000

7. Oversize vehicles – Section: 182 B – Old Penalty: New – New Penalty: Rs 5000

8. Dangerous driving penalty – Section: 184 – Old Penalty: Rs 1000 – New Penalty: Up to Rs 5000

9. Not providing way for emergency vehicles – Section: 194 E – Old Penalty: New – New Penalty: Rs 10,000

10. Driving Without Insurance – Section: 196 – Old Penalty: Rs 1000 – New Penalty: Rs 2000

11. Driving without licence – Section: 181 – Old Penalty: Rs 500 – New Penalty: Rs 5000

12. Unauthorized use of vehicles without licence – Section: 180 – Old Penalty: Rs 1000 – New Penalty: Rs 5000

13. Rules of road regulation violation – Section: New 177A – Old Penalty: Rs 100 – New Penalty: Rs 500

14. Travel without ticket – Section: 178 – Old Penalty: Rs 200 – New Penalty: Rs 500

15. Driving despite disqualification – Section: 182 – Old Penalty: Rs 500 – New Penalty: Rs 10,000

16. Disobedience of orders of authorities – Section: 179 – Old Penalty: Rs 500 – New Penalty: Rs 2000

17. Vehicle without permit – Section: 192 A – Old Penalty: upto Rs 5000 – New Penalty: Upto Rs 10,000

18. Aggregators (violations of licencing conditions) – Section: 193 – Old Penalty: New – New Penalty: “Rs 25,000 to
Rs 1,00,000”

19. Overloading – Section: 194 – Old Penalty: “Rs 2000 and Rs 1000 per extra tonne” – New Penalty: “Rs 20,000 and Rs 2000 per extra tonne”

20. Overloading of passengers – Section: 194 A – Old Penalty: – New Penalty: Rs 1000 per extra passenger

21. Overloading of two wheeler – Section: 194 C – Old Penalty: Rs 100 – New Penalty: Rs 2000, Disqualification for 3 months for licence

Newly Introduced Section in Motor Vehicles Amendment Bill

22. Offences by Juveniles – Section: 199 – Newly Introduced – Guardian / owner shall be deemed to be guilty. Rs 25,000 with 3 yRs imprisonment. For Juvenile to be tried under JJ Act. Registration of Motor Vehicle to be cancelled

23. Power of Officers to impound documents – Section: 206 – Newly Introduced – Suspension of driving licenses u/s 183, 184, 185, 189, 190, 194C, 194D, 194E

24. Offences committed by enforcing authorities – Section: 210 B – Newly Introduced – Twice the penalty under the relevant section

New Penalty Charges

Penalty regarding motor vehicles is to be increased by 10 % every year.

Starting this year online verification by Aadhaar is now mandatory to get a driver’s licence.

The Motor Vehicles (Amendment) Bill, 2019 also introduced automated fitness testing for vehicles, Good Samaritan guidelines, Recall of old Vehicles, cashless treatment of road accident victims during golden hour, Third Party Insurance a 10 time increase in insurance compensation, from Rs 50, 000 to Rs 5 lakh, and Provision for online driving licenses and Vehicle Registration.
